Saving Your Home Through Bankruptcy

Ideally, you should seek legal counsel from a skilled lawyer while you still have legal options. However, filing for bankruptcy will halt foreclosure proceedings anytime before the Public Trustee sale has occurred.

  • Chapter 13 bankruptcy may be the only solution if you are several months behind on mortgage payments. Chapter 13 immediately halts foreclosure and rolls those arrears into your bankruptcy repayment plan, spread out over three to five years.

  • Chapter 13 may allow you to strip a second mortgage or home equity loan if your home is “underwater” (the market value is less than you owe on the first mortgage). If eligible, lien stripping could eliminate tens of thousands of dollars in debt.

  • Chapter 7 bankruptcy cannot discharge mortgage arrears. However, if you are current with the mortgage but have substantial unsecured debts that threaten your ability to continue making house payments, Chapter 7 may make sense.

  • Chapter 7 can temporarily halt foreclosure to buy you time to negotiate a workout or loan modification with your lender.
